Why The Quick No Fault Divorce Can Solve Many Problems
No fault divorce laws have been one of the most significant developments in civil law in the past half a century. In the past, it was impossible to obtain a divorce without one party going in to a courtroom and alleging misconduct on behalf of the other. There had to be a serious breach of the marriage contract, such as adultery or cruelty from one party to the other. These laws are still in place throughout much of the Western world, but every one of the fifty states of the USA has now introduced the quick divorce.
It is important to realize that this dramatic change in the law is certain to increase the divorce rate, at least in the initial instance. There will be many thousands of people who were trapped in marriages which they wanted to escape from, but who were unable to escape without inventing false allegations, who are now able to finally get out. The only other option these people had in the past was to move to a jurisdiction where they would be granted the quick divorce.
The process of instigating a divorce was always carried out by a lawyer, and it always involved the allegation of misconduct by one party. Without this element, there was no basis on which to sue for divorce. The necessary involvement of lawyers inevitably led to a huge cost, not only to the individuals concerned but also to society. In the vast majority of cases, no defense was submitted, simply because an uncontested divorce would not incur extra expenses.
One of the greatest worries many people have when they know their marriage is no longer sustainable is the effect the break-up will have on the children. This is often overstated. Children will nearly always be perfectly aware that there are problems with the marital relationship long before they are told, and in any case they now have far greater exposure to the concept of divorce. Many will know other children who have faced the same situation. The real trauma comes during the time before the divorce, if there is a lot of bad feeling, blame and acrimony.
A quick no fault divorce can solve all of these problems, and give the children a stable life again as quickly as possible. This lack of disruption to a child's home life is a crucially important factor in allowing the child to resume studies quickly enough to be able to cope. It is when a child has extended periods of time away from education that problems set in. Once they have fallen behind, they are then unable to cope with the future material that they are exposed to. These problems can be eliminated with a quick no fault divorce.
